Greets and Huggers. Posted the evening of November 18, 2005. I
must admit I'm not a "political" animal. I am a complete novice. I am
and remain, a dumb ole country lawyer: no more, no less. I want to finish my
career in public service, as a judge, but to do so, I have to "run"
for office. I have to raise $30,000.00 while being prohibited from soliciting
funds. That means, I can not call you up, share with you what I want to do, the
changes I want to make, and ask you for money, so I can pay for yard signs,
newspaper advertising, radio advertising, handouts, yard signs, billboards,
etc. Fine, I can live with that: I guess that's what campaign committees are
for. The part I have a problem with, is, having to run as a Republican or a
Democrat, (no chance in hell of being elected as an Independent, Libertarian,
Communist, Socialist ... or otherwise.) Never mind, that Tom Delay had judges
disqualified, based on their political affiliation. Judges are the 3rd arm of
our government, entrusted to enforce the contract we have with our elected
representatives, our Constitution. Judges should not have to run under the
auspices of any political party. They should run as individuals, independents,
ask for your vote, based on their character, reputation/history for honesty,
ability, reputation for being impartial, fair, hard working, legal knowledge
and desire to abide by and subject themselves to the law.
DALLAS, Texas (Reuters) -- Study: Stem cells help heart after attack. "Heart attack survivors whose hearts were infused with stem cells from their own bone marrow showed nearly twice the improvement in the organ's pumping ability as patients given a placebo, according to a study presented Sunday." The study subjects were limited to atheists and non-Christians ... seems the folks conducting the study were concerned God would strike down Christians, for participating in the study.
Georgia (ABC) -- Pregnant 37-Year-Old Charged With Molesting 15-Year-Old Husband. "A 37-year-old pregnant woman is in custody on charges of child molestation after having a sexual relationship with a 15-year-old neighbor. Now the couple has gotten married, using a little-known loophole in Georgia law, and the boy's grandmother is hopping mad." ... "and here's to you Mrs. Robinson, Jesus loves you more than you will know, Woah, Woah, Woah" ... and your cell mate may as well. Times have changed, can anyone remember an older women being charged with molesting a 15 year old in 1967? Or for that matter, children being yanked into juvenile court for "playing doctor"? (Not that I am condoning either behavior!) .... and ... Pittsburgh (Post-Gazette) --- Teen who posted own photo charged with child porn. "State police have charged a 15-year-old Latrobe girl with child pornography for taking photos of herself and posting them on the Internet. Police said the girl, whose identity they withheld, photographed herself in various states of undress and performing a variety of sexual acts. She then sent the photos to people she met in chat rooms." Now that has to be one lonely kid!! ... <whispering> ..... does the phrase "Parental Supervision" ring a bell?
BERKLEY, Michigan (AP) -- School drops song about picking cotton. "A song about people picking cotton was pulled from a middle school concert in suburban Detroit after a black parent complained that it glorifies slavery ... when the song was picked for Wednesday's folk songs concert at Anderson Middle School ... " , "Porgy and Bess" has also been blacklisted, (no pun intended), in Michigan .....
Al Jazeera -- Heart therapy: Pat a dog. "It turns out dogs are more than man's best friend. They're pretty good at making the sick feel better, too, in ways that can be measured. A small study showed that visits from therapeutic dogs lowered anxiety, stress and heart and lung pressure among heart failure patients. "I'm not surprised at all that something that makes people feel good also makes them feel less anxious, has measurable physiological effects," said Marc Gillinov, a cardiac surgeon at the Cleveland Clinic who was not involved in the study. " Only Fundamentalist Christian dogs heal, with the laying on of paws, while Jewish Dogs just make you feel guilty for being sick. Plain old mutts, (no doubt atheists), just give you fleas.
CANBERRA, Australia (Reuters) -- Harriet the tortoise turns 175. "One of the world's oldest living animals, Harriet the tortoise, celebrated her 175th birthday on Tuesday -- with a pink hibiscus flower cake at her retirement home in northern Australia ... There is no doubt however over the age of Harriet -- who for more than a century was thought to be a male and named Harry ... " So, for over 100 years, no-one thought to check out what's between Harriet's little legs? Doesn't that beg the question .... why did someone finally look? Slow day at the zoo?
China confirms two human cases of bird flu. "China confirmed its first two human cases of bird flu Wednesday, adding to the global worry over a pandemic as the illness continues its spread across the Asian continent." That's China's public position. A dissident Website, http://www.peacehall.com/news/gb/china/2005/11/200511142123.shtml paints a different picture. The site is in Chinese, so a friend translated it: "The article says (in essence, not word by word translation)): Avian flu has occurred in several providences, and 200 - 300 people have died (since no accurate statistics available, the actual number could be much higher). The government took extreme measure to control the flu by isolating the patients and possible patients. If anyone has flu symptoms, he must go to special hospitals, which exclusively treat Avian flu patients, and stay there for a long period of time. The government also controls how the cause of death were reported or recorded. No government officials or employees can talk to reporters about the statistics or other information regarding the flu without permission. Any one who violates this rule will be fired on the spot. " So share with me .... who would you believe. ... and .... ( Bloomberg) --- Two Avian-Flu Deaths in Indonesia Not Linked to Birds. "Two Indonesian women who died from avian influenza earlier this month had no known contact with flu-infected birds, said a doctor at a hospital that treated one of the patients." Got your "Quarantine Stash" set up?
Got back from Jeff City about 5:30, attended the Solo and Small Firm Practice Committee Meeting. Three issues: the "Family Reunion" at Tan Tar a, the "Vacation Rule" and the "Picture ID" to bypass courthouse security question, stick in my mind. "The Conference" next year, will be OUTSTANDING ... with Jerry Spense attending, two Missouri Supreme Court Judges being presenters, being able to get ALL of your CLE and Ethics credits, while surrounded by other Solo and Small Firm guys, for less than $220.00, (including meals) sound like a deal? Make your reservation at Tan Tar A now! The "Vacation Rule", (a civil rule similar to the ones adopted in California, Texas, North Carolina, Georgia, Florida, et. al.), which, upon notice filed, allows you to take a vacation with your family .... no depositions nor hearings may be called up, while you are gone .... is in trouble. Seems our Judges feel a formal rule is not necessary, (THEY would take care of it), in spite of the fact that the survey conducted by our Bar ... showed 75% of the folks responding acknowledged that it IS a problem. We need a "Vacation Rule", period. Mark P has graciously agreed to be the point of the spear ... lead the charge. We need to compile examples, (anonymous of course), of situations you have experienced showing why we do.
As for the picture ID to by-pass courthouse security. It is deemed a "regional" problem, (only Cass, Jackson, Clay and Platte Counties issue Picture ID's to by-pass security, although each does not honor the card issued by the others). Most rural counties don't even have "security", while St Louis is so afraid of it's lawyers, they don't issue one at all. Everyone, except Judges and courthouse personnel have to go through the metal detectors. <Smiling> ... there were a couple of comments today, that there are some really scary lawyers out there. Maybe so .... but I have not found ONE case, ONE instance, involving a lawyer using a weapon in a courthouse. The courthouses are owned by the county ... security is owned by the local sheriffs department ... and the courtroom is owned by the judge. So share with me ... if the janitor, (or for that matter, any court employee can by-pass security), why, as officers of the court ... can't we? I for one, would be willing to pay an additional $20.00 per year, to have my MANDATORY BAR, mandatory because my SUPREME COURT makes it so, issue me a picture ID ... so I have the same rights as the janitor at my place of business? Perhaps, our Supreme Court should think about the possibility, that we are not the enemy! Perhaps they should consider, we are THEIR foot soldiers .... we are their allies in doing their most important job: enforcing the contract we have with our elected officials. Our Constitution!
I'm sucking down some Cream Sherry and feeling bummed out. I must be a real moron ... the issues seem so simple to me ... if ignorance bliss ... how come I'm bummed out? The janitor at my local courthouse gets a vacation and can come and go as he pleases, (he has a picture ID) ... but I have to sweat my ass off, if I take time off and have to wait in line, empty my pockets and get checked with the "magic" wand when I walk into my place of business, (even though, I'm a card carrying, dues paying, officer of the court). Makes sense, doesn't it?
I guess the good news is, I have the most wonderful, loving, sexy, partner to rag on when I do get bummed out. Wonder how Susan manages to put up with me? While going to sleep tonight, curled around her, I'll thank God for his tender mercies, (Susan being THE most important one) ... and I will also say a prayer/send good wishes for the safe return of our men and women in uniform, (care to join me?) .... <whispering> ..... Please, Please, Please, God, let them come home safe and soon! Be and sleep well ... the best there is, is on watch so you can. If my post offends, I apologize ... that is not my intent. As always ...
