These are the Ramblings of a small town, (Holden, population 2,700), Missouri, country lawyer. They contain my random thoughts and observations on current events and my life and experiences in the Solo Practice of law.

I have decided to finish my legal career serving the citizens of Johnson County, Missouri as their Associate Circuit Judge.  I ask for your support.

Greets and Huggers. Posted the evening of October 20,2006. Susan and I appeared on FOX4 on Monday, (the video replay, is at the bottom of the page). Strange ... seems the older I get, the more sensitive I have become to the needs of my older neighbors, (human and otherwise). Sad, but when some "companion animal" owners shift lifestyles, move into assisted living facilities or nursing homes, their "companions" get left behind or turned in, to kill shelters. They are discarded. After a life of service, these older "companion animals" deserve better. They are not livestock, (although the current state of our law, designates them as such ... perhaps another change that needs to be made). Perhaps you and I can raise awareness, that these creatures are also God's creations, perhaps not created in HIS image, but none the less, bearing HIS thumbprint and HIS mandate to us, to be good Shepherds. Share with me ... is there a difference between a cow, hog, horse, rabbit, chicken or dog and cat ... in the way you view them? Which would you view, (culture specific, no doubt), as "livestock" .... or "companion animals"? Put another way ... which would you eat? All, I suppose, should you be hungry enough, (history teaches, we will eat each other, when no other option is available!) I suppose the fly in the ointment is the guy who considers his "Pot Bellied Pig" a companion animal ... and the guy who wants to marry his mare, (I have always found "horse" people suspect. I always double my retainer for clients who own horses!) I guess, what I'm trying to say ... is dogs and cats have a special niche. They are fellow travelers. We genetically engineered them. They are a part of our respective families. They love us, no matter how much we abuse them, (and some of us do). I have a modest proposal. Designate dogs and cats as "companion animals", not livestock. Prohibit eating them. Increase sanctions for those who do or who physically abuse them. [Footnote: We have a rescue at Ft. Timmerman, whose eyes were "Super Glued" shut. She has lost vision in one eye ... and is horribly afraid. When she first came to Ft Timmerman, she would run and hide if you tried to approach her. Who could blame her? The good news ... after two weeks at Ft Timmerman, she is now a bag full of wagging tail when Susan talks to her ... hehehe ... course ... so am I ! ] Currently, we are the dominant species on this little oasis in the universe. That makes us the shepherds of our environment. The guardians of lessor species. Got news. That could change in a heartbeat. We remain one Flu Pandemic or asteroid collision away from being a very small strata in some future species excavation site/museum.

STRONGSVILLE, Ohio (AP) -- Tyson serious about fighting women on 'World Tour'. "Mike Tyson said fans should not expect much of a fight when he steps back into the ring ... At a news conference at an Italian restaurant, Tyson said he would likely go just four rounds and that future stops on the tour might include bouts with women," Bouts with women? Only women with no ears need apply ... <whispering> ... I like "nibbling" on Susan's ears ... but must admit ... have no desire to chump down on one. Guess there remains, no accounting to "taste".

TAMPA , Florida (AP) -- Indictment: Wesley Snipes a $12M tax cheat. "Movie actor Wesley Snipes, star of "White Men Can't Jump" and the "Blade" films, was indicted Tuesday on eight counts of tax fraud accusing him of trying to cheat the government of $12 million in false refund claims ... According to the indictment, Snipes had his taxes prepared by accountants with a history of filing false returns to reap payments for their clients. As part of the deal, the indictment alleges, the firm, American Rights Litigators, would receive 20 percent of refunds from clients." Mr. Snipes apparently listened to the arguments made by "American Rights Litigators" ... specifically a Mr. Eddie Kahn ... who made arguments like: " ... the IRS was not created by Congress ... that the IRS doesn’t have the power to collect taxes, that the United States doesn’t actually include the states, but is actually limited to the District of Columbia, that all the money collected from taxes goes to the International Monetary Fund ... and that so long as [you] keep out of the Social Security Program that you’ll never have to file taxes." Mr. Snipes also listened to "the preparer, Douglas P. Rosile Sr., [who] told clients that only income from foreign sources was subject to taxation." Mr. Snipe's location is unknown. I guess "White Men Can't Jump" ... but with 12 million dollars ... one African American man, no doubt ... can.

Just got in from attending the Solo and Small Firm Conference Planning Committee meeting in Jeff City. Corinne C, Dan R, Lyle G and I car pooled. Good company to travel with. It was great to see and hug old friends and plan the next meeting. The "theme" will be: "Solo and Small Firm Lawyers, the Heartbeat of Justice". There was some discussion pro and con, about limiting, (putting a cap), on conference attendance. We can not sustain the growing attendance rate and continue to have "The Conference" be what it is: a gathering of Solo and Small Firm Lawyers, to network and support each other. In biological terms, a small organism evolves and becomes bigger and bigger, until it is so large, it can not survives and becomes extinct or another organism. Made me wonder about the difference between a "conference" and a "convention". What is the difference? In my mind, I suppose, a "conference" is a gathering of equals, to gather, meet, greet, share information and support each other. A "convention" on the other hand, is an opportunity for folks in a given industry to get together and look at the latest and greatest, put out by support vendors. One is a means of reinforcing bonds, reinforcing a sense of community ... the other is a gathering of strangers serving their self interests. For the first time in the history of our Bar, Solo and Small Firm Lawyers, (who comprise 66% of our Bar), have a common voice ... on the SFIG and the SASFPC. Our Bar and our Supremo's are listening. We can now destroy files after 10 years of no contact with a client ... we now have a statute of limitations for Bar complaints. We still NEED a vacation rule! We still NEED a universal picture ID to bypass security, in those circuits who issue an ID to allow lawyers to do so. [NOTE: Last year, Cass County, (17th Judicial Circuit), installed metal detectors and Judge Dandurand authorized picture ID's for attorney's to by-pass security. I designed the picture ID and shot the portraits for it and issued the ID's, at my out of pocket cost of $10.00, (paid by the attorney's who wanted one). This year, Johnson County, (next month), will implement metal detectors ... and Judge Dandurand authorized picture ID's. I designed a picture ID and shot portraits of Johnson County attorney's for their picture ID, I asked Judge Dandurand to authorize a combined picture ID for both counties in the circuit. He authorized it ... so I designed and will issue a universal 17th Circuit picture ID to Cass and Johnson County lawyers, (at my cost, $10.00), good until/unless revoked. No yearly fees. The Johnson County Bar Association paid for the cards issued to their members.] Share with me ... why our Bar could not issue a Picture ID, honored in those counties who chose to issue picture ID's to by-pass security, (instead of that hokey plastic card that everyone throws in the trash because it serves no purpose other than to increase the bulk of your wallet!!)? Share with me, why there should NOT be reciprocity between Judicial Circuits!!! Share with me ... would you be willing to pay an additional $10.00 per year in Bar Dues, if the Bar did? .... <whispering> .... I KNOW I WOULD!!!

I have a busy day tomorrow. Those of you who have run for office, know the roller coaster ride, (let me share with you, there is a GREAT difference between being a "helper/supporter" and a "candidate". As a "helper/supporter", at the end of the day, you get to go home and get a good nights sleep. As a candidate, you get to go home and think about all the mistakes you made, what you could/should have done differently ... and you have to confront the fact, that you are a "loser".) One morning you wake up and think to yourself, "I can't lose!" ... and the next morning you wake up, and you think to yourself, "I can't win!". Never mind the, "I wish I had the money to do XXXXX". Tonight, I'm in the "can't win" mode. My choice ... I wanted to help plan the next "Conference" ... instead of asking folks for their vote. No doubt, my opponent was out asking. My radio ad starts Monday and I worry that folks may view it as an attack: it is not meant to be. I like and respect my opponent, as I hope, she does me. And all the while, Susan just loves me ... hugs and tells me, no matter what, she will be here for me, (and kick my *ss if I lose! :) Me? I just look forward, at the end of the day, curling myself around her, holding her ... and while drifting off to sleep, thank God, for the ability to do so. I also pray for the safe return of our men and women in uniform, (care to join me?) ..... <whispering> .... Please, Please, Please, God ... let them come home safe and soon!!! Be and sleep well, the best there is, is on watch, so you can. If my post offends, (I feel like a loser tonight), I apologize ... losers should.
