These are the Ramblings of a small town, (Holden, population 2,700), Missouri, country lawyer. They contain my random thoughts and observations on current events and my life and experiences in the Solo Practice of law.

I have decided to finish my legal career serving the citizens of Johnson County, Missouri as their Associate Circuit Judge.  I ask for your support.

Greets and Huggers. Posted the evening of October 13, 2006. This may be one of the last Ramblings, depending on the outcome of the November 7 election. Over the last few Ramblings, may I share some of my religious/philosophical views? In response to last weeks Ramblings, a Dear Friend wrote: "Some people's minds are so open that their brains fall out. The Catholic priesthood does not have a problem with pedophilia. According to the John Jay report over 80% of the incidents with priest occurred with prepubescent boys. The problem should be spoken of as homosexual priests. The political correctness that makes people afraid to question that behavior explains the "cover-up". The new political correctness is that homosexuality is okay and God forbid I be accused of gay-bashing. Homosexuals should not be allowed to be around young boys, PERIOD. In an earlier and I think more commonsense time people understood that this kind of behavior is deviant and shouldn't be socially sanctioned. If you think it is okay to bash priests, I think it is okay to say what the truth is. Catholic priests deserve better than your kind of thinking." I don't normally do so, but I thought I would respond. First, at a "gut" level. "Nanny, Nanny, Boo, Boo!!" .... <felt good to say> .... Ok. Responding as a rational adult. My Friend wrote: "Some people's minds are so open that their brains fall out." Very true, my Dear Lady Friend ... and some people's minds are so closed, the neurons in their brains can only fire in closed loops resulting in intellectual catatonia. Homosexuality is a sexual orientation. Pedophilia is a sexual preference. That means, and the facts teach, that you can have heterosexual and homosexual pedophiles. The point of that portion of last weeks Ramblings was and remains: a person's vocation does not determine their sexual orientation nor preferences. Their sexual orientation or preference may, on the other hand, play a factor in which vocations or activities they chose to engage. That leaves the true issue of contention. Not one of fact, (the facts remain the facts), but one of moral belief structure. Reasonable, honorable, people can differ on "moral" issues because all evidence suggests "Moral Issues" are culture specific. Look at the age of consent in differing nations/societies. Look at "family" definitions in different cultures, specifically, monogamous family structures, polygamous family structures and polyandrous family structures and .... <sigh> .... the differing cultural definitions of what/who constitute a "family". Look at what different societies consider substance abuse, for example, the consumption of alcohol is forbidden in most Islamic cultures, yet the use of tobacco, hashish. et. al. are tolerated and in Western Europe, the use of most drugs is tolerated, (in an effort to decriminalize abuse). Look at how different societies view "prostitution" ... it is legal, regulated/controlled and taxed in most of the rest of the world. Doesn't that beg the underlying question: what right does any individual or group of individuals have, to impose their "moral construct" on me, or our society in general? ... if God, the ultimate POWER will/would not do so? ... <whispering> ... didn't God grant us "Free Will"? Share with me, why ... a God, who gives a divine spark, puts a divine thumbprint on all HIS creations ... would grant any individual the right to decide what is "moral" or "immoral", for others, in HIS name?

My Dear Lady Friend ... would you be willing to share with me which "laws" in the "Old Testament" still apply? Would you share with me, out of all the prohibitions in the Old Testament, which laws are carried over to the "New Testament" and who decided which ones do and which ones don't? Is there a book in the Bible ... outlining the repealed prohibitions? Isn't the fundamental premise of Christianity ... HE sacrificed himself for the forgiveness of ALL sins? If we are forgiven, why would there be prohibitions? .... other than love, accept and forgive each other, as our God, the God of love and acceptance, forgives us? ... <whispering> .... didn't the Amish folks, attending the funeral of the person that killed their children, display such grace? .... <sigh> ... talk about walking the walk ... instead of televising the talk! As for me, I remain seeking, not because I feel uncomfortable with the relationship I have with my GOD ... but because, I want to learn and experience how HE has revealed HIMSELF to others. I want to learn more about HIM. One of the reasons, I truly enjoy spending time with my Dear Friend, Rabbi Jacques C. .... <chuckling> .... who asked one of his daughters, while we were having lunch after he, and his daughters walked in the Chilhowee parade with Susan and I: "What would make your Daddy happy?" ... her response: "I should marry a Jew!" :) ... He is the Rabbi of the Reform Temple in Kansas City. I called him on that. His response: "My belief that they should marry a Jew is not racism, but a deep conviction that they will be happier with someone that shares what I hope will be their fundamental values. Also, remember that as a Rabbi, I am vested in preserving our culture and way of life". Does he love his daughters? No doubt in my mind! You have no idea, how much I value his Friendship. How much I value his views. How much, his views, have focused my own ... <whispering> ... Don't know if you will read this Jacques ... but thank you, my Dear Friend! When the time comes, (and it will), I want to feel my GOD's loving hands embrace my face ... and watch HIM smile ... and say to me: "Welcome HOME. So what did you learn?" I believe, what makes you and I, is not "matter" ... not physical ... "matter" is finite. What makes you and I, is the divine spark embedded in our soul, created by HIM and in HIS image .... this is the core of "soul". That divine spark makes us part of GOD. How else would you account for our need to find GOD, create creation myths, seek purpose and meaning in our lives, try to explain death? Aren't we all, as human beings, seeking the path ... which will lead us HOME? My reading of scripture suggests, the Devil, was an angel who fell from grace because of arrogance and pride. Seems to me, there is no shortage of "arrogance and pride" in some of our Christian, Jewish and Muslim communities. Food for thought. Truth remains truth. In your heart, GOD has placed a spark, a compass, to help you find the moral high ground. The bedrock of that moral high ground remains tolerance, love and acceptance of the many, many, ways our human family, all HIS children, view and live this reality. Perhaps, the greatest wisdom remains; "Judge not ... lest you be judged." [Matt 7.1]

ERIE, Pennsylvania (AP) -- Woman charged with using baby as weapon. "A woman used her 4-week-old baby as a weapon in a domestic dispute, swinging the infant through the air and striking her boyfriend with the child, authorities said ... Chytoria Graham, 27, of Erie, was charged with aggravated assault, reckless endangerment and simple assault. She was held Monday in the Erie County Jail in lieu of $75,000 bail. The infant, whose name was not released, suffered a fractured skull and some bleeding in the brain, authorities said. His head hit Graham's boyfriend, the baby's father, police Lt. Dan Spizarny said." So much for the urban myth that there is such a thing as "maternal instinct", (there isn't ... click on the link. It is an interesting read). Somewhere on our evolutionary march, we traded nurture for nature. We traded socialization for instinct, (instinct being defined as genetically programmed behaviors). Behaviors locked in stone are not adaptive/changeable, locking a species into extinction, should environmental factors change. Proof lies in a history of mass extinctions, of species, unable to adapt to environmental or social changes. <smiling> ... other than viri, bacterium and cockroaches, we are the most adaptive life form on this planet. Guess we keep good company. After all, like viri, bacterium and cockroaches ... aren't we, as a species, parasitic life forms? Share with me anything, anything! ... we as a species contribute to our ecosystem. We do not even contribute our ashes when we die ... in our individual arrogance and pride, we contaminate our remains, so they are unusable ... and can not return to the earth and be part of the "dust" that forms new life. (CNN) -- People power: U.S. to top 300 million. "At 7:46 ET Tuesday morning, the United States will become a nation of 300 million people, the U.S. Census Bureau estimates." Yup, this little oasis in the universe needs more humans.

CAPE CANAVERAL, Florida (Reuters) -- NASA considers Frenchman for space station stint. "When NASA ferries Europe's Columbus scientific research module to the international space station next year it may send along a Frenchman to operate it as well. If the plan is approved, French astronaut Leopold Eyharts would likely would get the nod to begin a series of two- to 2 1/2-month station expedition missions by astronauts from NASA's partner countries, European Space Agency astronaut Hans Schlegel said in an interview. Won't happen. The French are too Anglophobic. Not enough money in the budget to convert all the labels/instructions on the Space Station to French. And even if there were, who, other than the French would care?

LONDON, England (Reuters) -- 'Schizophrenia' should be dropped, experts say. "British mental health experts on Monday called for the term schizophrenia to be dropped, saying it has no scientific validity, is imprecise and stigmatizing. "It is a harmful concept," said Professor Marius Romme, a visiting professor of social psychiatry at the University of Central England in Birmingham. He added that symptoms such as delusions, hearing voices and hallucinations are not the results of the illness but may be reactions to traumatic and troubling events in life. Speaking at a news conference, Richard Bentall, a professor of clinical psychology at the University of Manchester, said the concept of schizophrenia is scientifically meaningless." Mental health experts are now debating what label to use. Some experts, (from a Christian slant), prefer "Possessed", (especially those of the fundamentalist persuasion). Muslim experts suggest no label ... unless the subject is a suicide bomber .. in which case, they prefer "Martyr". Jewish experts, on the other hand, suggest ... "Putz", (have no clue what that means.) My own opinion? I prefer "screwed in the head". What testimony, as a lawyer, would you prefer from an "expert witness"? .... "In my expert opinion, your Honor, the defendant is possessed ... a martyr ... a putz ... or ... screwed in the head?" Now, honestly, wouldn't "screwed in the head", play better to a jury? Wouldn't they understand that label better than, "putz" or "possessed"? On second thought ... perhaps, "possessed" might be a better choice. What do I know?

SAN FRANCISCO, California (Reuters) -- Advances allow many more soldiers to keep limbs. "A 2004 shooting and roadside bomb injury in Iraq left U.S. Marine Sgt. Oscar Canon, 25, with a gaping hole in his thigh the size of a baseball -- a wound should have cost him his leg. Yet today he can walk and run again ... the amputation rate in the Iraq conflict is just 20 percent compared with 76 percent during the Vietnam War, translating into thousands of saved limbs." So share with me ... what is it about our species ... that, we make the greatest advances in science, the greatest breakthroughs, when we are seeking a better, more efficient way of killing eachother? There have been massive advances in trauma medicine and bio-mechanical , (prosthetic), devices ... we have made advances is diagnosing and categorizing emotional trauma but have had no corresponding advances in healing mental scars. These mental scars in some cases can be more debilitating than dealing with physical trauma.

It is the evening of Friday the 13th. Spent this afternoon shooting the portraits of Johnson County lawyers for a picture ID, so they can bypass the new metal detectors at the Johnson County Justice Center. Judge Dandurand was kind enough to authorize a unified picture ID for both Cass and Johnson Counties, (the 17th Judicial Circuit), so the lawyers that practice there don't have to buy both ID's. Share with me why, if a county elects to have photo ID's issued to by-pass metal detectors, they could/should not honor a photo ID issued by a sister county? Of course, the most logical solution is to have our Bar offer, (for a nominal charge), a photo ID, usable in any county that elects to offer lawyers the option of by-passing the metal detectors at it's courthouse.

Sitting here editing these Ramblings, sipping on some Port, (took this evening off), and watching the evening news. A controversy in the Republican Party: Christian conservatives are suggesting the party is pro-gay because Republican Congressmen have gay staffers. Give me a break! What's wrong with hiring happy people? We have the UCM Homecoming parade in the morning. (CMSU changed it's name to the University of Central Missouri). ... <scratching my head> .... so, is it still "Homecoming", if a school changes it's name? Susan and I will be on the FOX 4 Morning Show, (with Loren Halifax) on Monday morning at 8:50, to talk about being "Furry Foster Parents" for older/sick dogs. Susan has enough love in her heart to take care of these sick/dying dogs ... let them know, make sure, their last days are filled with love ... and hold them, when it comes time because they are in pain, to help/let them cross over to the "Rainbow Bridge". Silly perhaps, but she adopts them just before they pass, (sometimes the same day) ... so they know they have a "human" to wait for, when they get there. What is not silly, is the love, admiration and respect I have for her commitment to loving these little dogs, after they have been discarded by their owners ... <whispering under my breath> ... these "owners" are a waste of perfectly good skin ... I can not imagine abandoning/turn out, a sick/dying animal. Tonight as I go to sleep, holding my Susan, I will say a prayer of thanks for being able to do so ... and I will say a prayer for the safe return of our men and women in uniform, (care to join me?) .... <whispering> .... Please, Please, Please, God ... let them come home safe and soon. Be and sleep well, the best there is, is on watch so you can. If my post offends, I apologize ... that is not my intent. A always ....
