These are the Ramblings of a small town, (Holden, population 2,700), Missouri, country lawyer. They contain my random thoughts and observations on current events and my life and experiences in the Solo Practice of law.
Compiled here are the Ramblings for 2002 - 2006.

I have decided to finish my legal career serving the citizens of Johnson County, Missouri as their Associate Circuit Judge.  I ask for your support.

Greets and Huggers. Posted the evening of August 25,2006. Running for office is like being infected with a flesh eating bacteria ... it becomes all consuming. Those of us, who hate to lose ... type "A" personalities ... who view ourselves as "Advocates", "Warriors", "American Samurai" .... , (we are, aren't we?) ... eat, sleep, poop our campaigns. Everything becomes a self serving, potential media experience: a photo op, (like congratulating the State Fair Queen). You become so focused on your campaign, it becomes difficult to maintain perspective. Keep track of what matters. I really miss having the time to respond to individual SFIG posts. I miss the one-on-one mentoring, the phone calls offering encouragement to our "Family's" ... "Puppy Sharks" ... and "Family" members going through a hard time, (what a blessing to have had the privilege/opportunity to visit with so many of you, over the years!!) I miss emphasizing and preaching what I consider the "Lawyer's Creed": "There is no substitute for taking the moral high ground in life ... and ... there is NO EXCUSE for NOT taking the moral highground in the practice of law!!" I miss leading the charge for a vacation rule similar to the rules adopted by Texas, Georgia, California, et. al, (so upon notice filed with the court, you and your family can take a vacation without having to worry about some putz calling up a deposition or some BS motion) ... compelling the OCDC to carbon you in on ANY complaint filed, whether they decide to investigate or not, (instead of just putting it in your file) ... and having our Bar issue a universal picture ID, instead of having county Bar Associations issue, (and charge for) picture ID's to by-pass courthouse security in those counties who have opted to do so, (and refuse to accept a sister county's picture ID!). Aren't these simple changes that would make the practice of law, for solo and small firm lawyers, (you know ... those of us, who comprise 2/3rds of our Bar), so much easier? Why isn't our BOG leading the charge? .... <smiling> .... you listening, Alan! :) .... <whispering> .... call YOUR BOG rep and ask him/her, why he/she isn't leading the charge!!!   You and I fund 2/3rds of our Bar and 2/3rds of our OCDC ... with our dues.  Share with me ... feel like you are getting your money's worth? If not ... keep in mind ... the squeaky wheel gets the grease.    'Nuff said.

LOS ANGELES, California (AP) -- Hit-run grannies allegedly drugged victims. "Two elderly women accused of killing two homeless men in hit-and-run crashes to collect their life insurance drugged the victims before slowly running them down, authorities said Thursday ... The murder charges carry special allegations that could make the women eligible for the death penalty if convicted." Only in California! So Olga Rutterschmidt, 73, and Helen Golay, 75 face either life in prison or the death penalty? Share with me how, expending limited State funds, to seek the death penalty for a 70+ year old makes sense? How about you house arrest them in a trail park in Little Rock, Arkansas?

And, judicial news ... judges at their best?:   BRISTOW, Oklahoma (AP) -- Judge jailed for exposing himself during trials. "A former judge convicted of exposing himself while presiding over jury trials by using a sexual device under his robe was sentenced Friday to four years in prison. Donald Thompson had spent almost 23 years on the bench and had served as a state legislator before retiring from the court in 2004. He showed no reaction when he was sentenced." See what serving as a legislator does to you? (Looking at my Dear Friend, Matt Hill.) As for not having a reaction?  4 years is a long time to sleep with one eye open ... hoping that the embargo against sexual devices in prison is absolute.  Guess our good judge will find out the difference between being a reactee ... and a reactor .... and ... BBC NEWS -- Filipino 'dwarf' judge loses case. "A Philippines judge who said he consulted imaginary mystic dwarves has failed to convince the Supreme Court to allow him to keep his job. Florentino Floro was appealing against a three-year inquiry which led to his removal due to incompetence and bias. He told investigators three mystic dwarves - Armand, Luis and Angel - had helped him to carry out healing sessions during breaks in his chambers. The court said psychic phenomena had no place in the judiciary. The bench backed a medical finding that the judge was suffering from psychosis." Makes you wonder, doesn't it ... if Judge Donald Thompson, wasn't visiting with his magic dwarf to help him render a decision? Armand, Luis, Angel ... and ... the newest dwarf: "Okie". [Footnote: "Dwarf" is no longer a politically acceptable term. "Little Person" is. So guys ... you don't have a "dwarf" ... you have a "little person". Makes sense when you consider at times the little person seems to have a mind of his own. ] ... and in other "legal" news:

BOSTON (MSNBC) - Transgender inmates seek sex-change surgery. Issue of taxpayer cost divides attorneys, lawmakers. "Wearing lipstick, a scooped-neck sweater and nearly waist-length hair, the witness cried while describing what it feels like to be a woman trapped inside a manís body. "The greatest loss is the dying I do inside a little bit every day," said Michelle Kosilek, an inmate who is serving a life sentence for murder." Breaks my heart, that he is dying in his heart a little at a time. I'm sure his victim's family isn't shedding any tears.  I'm curious: if he does get a sex change operation ... does he remain in the male prison ... or would he get transferred to a female facility?

LONDON, England (Reuters) -- Farmers: Cows mooo with a twang. "Cows have regional accents, a group of British farmers claims, and phonetics experts say the idea is not as far-fetched as it sounds. Lloyd Green, from southwest England, was one of a group of farmers who first noticed the phenomenon ... "I think it works the same as with dogs - the closer a farmer's bond is with his animals, the easier it is for them to pick up his accent." So .... just how much of a bond do you have to form with your cow, to have it "Mooo" in your particular dialect? One would think, "milking" your cow would be enough. Hard to tell. Cows are udderly discrete. You can play with their teats, (milking them) until the [other] cows come home ... and keep a secret. Course, what do I know. I remain a cow-ard when discussing this issue. With the foiled terror plot in the UK ... and with 48 Million middle class Americans without health insurance, without affordable health care and the rest of us, with double digit increases in our health insurance premiums ... reporting about cows having an English accent, makes a nice news distraction ... doesn't it?

NEW YORK (Reuters Health) -- Breast implants linked to suicide, but not cancer. "A large Canadian study adds to evidence that women with breast implants do not face a higher risk of cancer or other major diseases, but they may have a higher-than-average rate of suicide. Among the more than 40,000 women in the study, those who'd received cosmetic breast implants had lower-than-average risks of dying from breast cancer, heart disease and a host of other major diseases." Ok. So you get a boob job and you have a "lower-than-average risks of dying from breast cancer, heart disease and a host of other major diseases". Like the probability of living longer, is a good reason to kill yourself? Perhaps the persons who committed suicide after a boob job ... did so after getting the bill ... or perhaps they were joggers ... suffering from an irrational fear that their boobs would beat them to death?

WASHINGTON (CNN) -- Bush pardons moonshining 'Deliverance' actor. "By granting absolution to a convicted moonshiner, George W. Bush also earned the unique distinction of becoming the first president to pardon a cast member of the 1972 Academy Award-nominated movie "Deliverance." Randall Leece Deal of Clayton, Georgia, had a small role in the film about four Atlanta businessmen who have unpleasant encounters with locals during a north Georgia canoe trip." Deal was not involved in the infamous rape scene with actor Ned Beatty. He had a one liner, "It ain't nothing but the biggest **^&$^# river in the state!" I wonder, given this administration's blurring of some aspects of reality, would it have made a difference if Deal was involved in the rape scene? I have this vision of "Dueling Banjos" playing in the background while our President signed the pardon. [hehehe .... love that dueling banjoes link!!! ]

SALT LAKE CITY (AP/KSL News) -- Pro-polygamist Teens Defend Their Families. "Calling their lives blessed, more than a dozen young women and girls from Utah polygamist families spoke at a rally Saturday, calling for a change in state laws and the right to live the life and religion they choose ... The youth, ages 10-20, belong to various religious sects, including Apostolic United Brethren, the Davis County Cooperative Society, and Centennial Park, as well as families that practice polygamy independent of religious affiliation. They had their own band and brought their own signs and one after the other, stood up before the crowd to speak out in defense of polygamist families. They spoke voluntarily, but gave only their first names, saying later they were protecting the privacy of their parents" They were also protecting their parents from potential criminal charges. These kids have a Website. I have no doubt these children believe they are protesting, what they consider, an injustice. There is a saying ... "as the twig is bent ... so the tree shall grow ." There are some really twisted trees in the deserts of Utah. The fact remains, religious freedom,  like free speech ... is not absolute.

Sitting here editing these Ramblings and planning my "walking door to door" agenda for tomorrow and Sunday afternoon. On the evening news, State Farm is under investigation by the FBI for defrauding it's gulf states policy holders, victims of Katrina. Snake Farm forged and altered documents to avoid paying claims. Surprise, surprise. [An in depth report on 20/20 this evening for those who have an interest in having their distrust of corporate America reinforced!] Susan "rescued" a little Yorkie this week ... this little animal, "Corkey" has cancer and is dying.  Her "family" abandoned her ... left her, abandoned her on the street. Animal control took her to a Vet we know and he called Susan. So, Corkey is here at Ft Timmerman. What kind of person drops a helpless, hurting, scared, sick animal of on some street corner ... to die a slow death, alone, unloved. I would like to spend an hour alone, in a locked room with this pilgrim ... so ... I ... er ... can pray with them. Share with me ... why our species should survive ... as the guardians of God's creations?

Susan took little "Corkey" to "7 Bells Sanctuary"s vet today. Corkey was spayed, had rotten abscessed teeth removed ... and as many of the cancerous tumors, as possible, excised. Susan's compassion and love for her "furry babies" amazes me. She has the capacity to love selflessly. Hold and weep, when one of her "babies" is ready to go to the "Rainbow Bridge". She is the person I am working hard to become and the reason I say a prayer of Thanks, (that she is a part of my life) ... when we drift off to sleep holding eachother. We really are one person. Tonight, as I say my usual prayer of thanks ... I will also say a prayer for the safe return of our men and women in uniform, (care to join me?) .... <whispering> .... Please, Please, Please, God ... let them come home safe and soon! Be and sleep well ... the best there is ... is on watch so you can. If my post offends ... or feeds one of your conspiracy theories, (I am, after all, a 29 year member of the American Legion, a 22 year member of Missouri Masonic Grand Lodge, Scottish Rite and the Ararat Shrine) ... I apologize ... that is not my intent.  As always ...
