These are the Ramblings of a small town, (Holden, population 2,700), Missouri, country lawyer. They contain my random thoughts and observations on current events and my life and experiences in the Solo Practice of law.

I have decided to finish my legal career serving the citizens of Johnson County, Missouri as their Associate Circuit Judge.  I ask for your support.

Greets and Huggers. Posted the evening of August 4, 2006. So Mel Gibson signed himself into rehab. While drunk, he made anti-Semitic comments. Sad. Sure don't want to believe he is a bigot. Only he knows what is in his heart. Neither you nor I do. Share with me ... is alcohol a "truth serum"? ... does it remove inhibitions carefully held in place by our conscience? Does alcohol cause confusion, blur the line between thoughts ... and actions in real life? Some believe it does. Some don't. There are still folks who still think "alcoholism" is a "character defect". It isn't. It is a disease, according to the "Diagnostic and Statistical Manual of Mental Disorders", Fourth Edition, published by the American Psychiatric Association, (APA), as well as in the "International Classification Diseases", published by the World Health Organization, (WHO). Alcoholism is chronic, (meaning, there is no cure), but can be managed. So, are you an alcoholic? The World Health Organization has developed a cross-cultural, 10 question test. You want to take it? Here it is. http://whqlibdoc.who.int/hq/2001/WHO_MSD_MSB_01.6a.pdf   On the other hand, alcohol abuse, may be a character defect:   after all, what kind of person would guzzle a 20 year old single malt?   'Nuff said.

There was some discussion about "A Kansas church group that protests at military funerals nationwide filed suit in federal court, saying a Missouri law banning such picketing infringes on religious freedom and free speech." ACLU. The bottom line remains, our elected representative can "regulate", (not abrogate), free speech, (note the many cases dealing with kiddie porn or porn in general, libel and slander cases ... ad nauseam). In my mind, demonstrating at funerals, is every bit as obscene. Funerals are a special form of "private" event, protected by a family's right to privacy ... and those attending, subjecting themselves, by attending, to the "rules" governing conduct, established by the family. I see nothing wrong with regulating "hate" speech ... by limiting distance and duration. Share with me ... how is Phelps's nutcases picketing the funeral of one of our fallen heros any different than Neo-Nazis picketing the funeral of a Black or Jew? Isn't it a "hate crime" to do so? How is either, protected 1st Amendment speech? Free speech isn't free ... it has been dearly paid for ... and should not be sanctioned as a shield to commit "hate crimes".

TOPEKA, Kansas (AP) -- Evolution opponents suffer setback. "Conservative Republicans who pushed anti-evolution standards back into Kansas schools last year have lost control of the state Board of Education once again ... As a result of Tuesday's vote, board members and candidates who believe evolution is well-supported by evidence will have a 6-4 majority. Evolution skeptics had entered the election with a 6-4 majority." If I were one of the folks not reelected, I would feel really bad ... after all, according to their belief structure, wouldn't it mean God did not want them to win? They have been "Naturally De-selected" ... by "Intelligent Design".

NEW YORK (Reuters) -- Site offers death alerts for baby boomers. "A social networking Web site for Americans aged 50-plus went live on Monday -- complete with an online obituary database that sends out alerts when someone you may know dies and that plans to set up a do-it-yourself funeral service ... "The death business is growing," Taylor told Reuters, offering figures showing the number of deaths in the United States rose to 2.4 million in 2005 from 2.2 million in 2000, and was projected to rise to 4.1 million by 2040." How depressing is this? You raise your children, finally feel comfortable in your chosen field ... looking forward to retiring ... and you want to get an Email announcing one of your friends has bit the big one? Although, I must admit ... I have started reading the obituaries. It is most disconcerting ... to recognize names. Reminds me that I am the last standing of my childhood "buddies": "Chicken Bob" died in 1989, "Freddie the Frog" died in the early 90's ... and "Fat Louie" died a couple of years ago ... (and NO! I will not share my "nickname"!!) There are seasons in life, each with it's special character ... like the Sinatra Song, "Very Good Year":

But now the days grow short

Im in the autumn of the year

And now I think of my life as vintage wine

from fine old kegs

from the brim to the dregs

And it poured sweet and clear

It was a very good year

NEW YORK (AP) -- Lactivists: Where is it OK to breastfeed? "I was SHOCKED to see a giant breast on the cover of your magazine," one person wrote. "I immediately turned the magazine face down," wrote another. "Gross," said a third. These readers weren't complaining about a sexually explicit cover, but rather one of a baby nursing, on a wholesome parenting magazine -- yet another sign that Americans are squeamish over the sight of a nursing breast, even as breast-feeding itself gains more support from the government and medical community." Give me a break! How can anyone find one of the most basic human functions, a mother nursing her child, offensive. Ah ... Yes!!! I remember now ... our government's policy of "Don't ask ... Don't tell" has obviously bled over into the civilian sector. Share with me ... what does it say about our society, when a picture of a nursing breast, evokes such responses?

BBC NEWS - Israel urged to shun cluster bomb. "US-based Human Rights Watch says Israel has used cluster bombs in civilian areas during its assault on Lebanon ... "The law of war requires you to distinguish between soldiers and civilians, so when you are using an outdated, unreliable weapon in a populated area, it is likely that the attack violates international humanitarian law."" First, "Cluster Bombs" are not outdated technology. Second, Israel isn't using them ... they are using "smart bombs", (they just ordered a bunch more from us.) And finally, where is the statement from Human Rights Watch condemning Hesbulah's rocket attacks on Israeli civilians?

GENEVA, Switzerland (AP) -- U.N. panel: U.S. must protect blacks, poor in disasters. "The United States must better protect poor people and African-Americans in natural disasters to avoid problems like those after Hurricane Katrina, a U.N. human rights panel said Friday. The U.N. Human Rights Committee said poor and black Americans were "disadvantaged" after Katrina, and the United States should work harder to ensure that their rights "are fully taken into consideration in the reconstruction plans with regard to access to housing, education and health care." I agree. I think we should stop all foreign aid immediately and use the money here at home. Concurrently, I think UN members should send their foreign aid to the gulf states, So share with me ... other than our friends in Europe, how many nations actually have foreign aid programs? .... <whispering> .... I couldn't find any, (course, I didn't look that hard!)

Sitting here editing these Ramblings, sipping on some Sherry and thinking about Tuesday. I have another 600 door bags to fill tonight, (a long slender plastic bag, containing my "push ad", a campaign emery board and one of my pens. If no one answers the door ... it has a hole punched in it, so you can hang it from the door knob.) My opponent in the primary is running newspaper ads ... my mailing, (4,000 pieces) went out yesterday .... my newspaper ad has been running all week. And my final large ad will run on Monday and Tuesday. My radio ads have been running all week.   In a bizarre twist, someone NOT ME, is running attack radio ads against my opponent and endorsing me as a "better choice"!!! I don't know who is doing it, don't want to know ... and sure don't want anything to do with it. I swore I would run a clean campaign ... and have done so. Some friends and I will go door to door tomorrow ... and Susan and I have a garden party Sunday afternoon. Win or lose, Susan and I have given it our best shot. When I started this race, I had NO name recognition ... now when I go door to door ... folks say ... "Yeah. I see your signs everywhere." Encouraging, until you realize, signs aren't votes!! :)

As a candidate you have incredible "ups" and "downs" .... I could never have done this dance without my "SFIG Family" ... Thank you for your support, (financial and moral) ... and my Susan. I have no clue, what I did, to have such a wonderful, supportive partner.  So I guess, I will just say a prayer of thanks tonight, as I drift off to sleep holding her ... and pray for the safe return of our men and women in uniform, (care to join me?) .... <whispering> .... Please, Please, Please, God .... bring them home, safe and soon!!!   [Earlier in the week, while campaigning ... had a pilgrim ask about "all the atrocities being committed by our troops in Iraq" ...  how would I deal with them, if I were the judge. I just walked away. Sat there later fuming.  I should have defended our men and women in uniform. I didn't.]  Be and sleep well, the best there is, is on watch so you can ... here at home, some fall short in defending them ... like me.   If my post offends, I apologize, that is not my intent.   As always ....
