These are the Ramblings of a small town, (Holden, population 2,700), Missouri, country lawyer. They contain my random thoughts and observations on current events and my life and experiences in the Solo Practice of law.

I have decided to finish my legal career serving the citizens of Johnson County, Missouri as their Associate Circuit Judge.  I ask for your support.

Greets and Huggers. Posted the evening of July 28, 2006. I had an epiphany this week. I think I may have discovered why men and women see the world differently. It's a question of heat. The human body is a chemical machine ... but a machine, none the less. All machines generate heat. If it's temperature goes below 98.6, it suffers from hypothermia ... if it goes above 98.6 ... it suffers from hyperthermia. Our brain HAS to remain at 98.6 or it will start to malfunction. Therein lies the problem. Males have extra heat dissipators which allows more efficient cooling of the blood flowing to the brain: both heavily veined ... and both air cooled, (all the more reason to wear loose fitting shorts). Both, just hanging there, dissipating heat ... keeping the blood flow to the brain at 98.6. Females on the other hand ... don't have that advantage, (although some have rather large, chest mounted, heat exchangers, although, not as heavily veined, and therefore, not as efficient in dissipating heat). No external air cooling, no external heat dissipation. I can only surmise, blood temperatures in females can vary, especially to the brain, perhaps causing portions of the brain to overheat. Brain overheating may cause an enlightened view of reality ... or, a psychotic episode. Sometimes hard to distinguish between the two. The net result being, some females swing between enlightenment and psychotic episodes, (would be interesting to fashion a study with the variables being, chest heat dissipater size, enlightenment and psychotic episodes ... hair color may also be a factor, although, I have no idea, how.) Males .... just gather together, do male bonding things ... and plod along. Their additional appendages, although superior heat dissipators, for some males, remain a handicap .... the tubular heat dissipator is prone to spontaneous swelling and developing a mind of it's own.

I read the Israeli/Lebanon posts on the SFIG with interested. Certainly divergent points of view. Some pro-Israel ... some con. All "Monday Morning Quarterback" opinions. I understand the West's pro-Israel position: it is called guilt. The West watched millions of Jews murdered in the 30's and 40's. The West did nothing to help, nor prevent it. How could we not feel guilty? [Never mind, we have no problem with the on going genocide in Africa, (Darfur, Nigeria, Angola, ad nauseam), the past genocide in the Balkins or the far East, (Cambodia) .. not to mention Nepal]. And you also have the fundamentalist Christian element to factor in .... Jews are the "chosen people". And Israel, as a Nation, is the focal point in the last book in the New Testament: "Revelations". However, there remains no difference between Jewish, Christian and Islamic fundamentalists, only the target of their venom. Hesbalah/Hamas is what it is ... an organization dedicated to the extermination of all Jews and Israel in particular. ... I understand Israel's position and goal. I don't understand Israel's actions. For the past 2,000 years, Jews, as a religious group, as a people, a race, have been systematically exterminated. Why would/should they "appease" anyone, when history teaches, there is no hope of peaceful co-existence? Every "peace accord" Israel has signed, has been violated. (Sure reminds you of the treaties signed by Native Americans, doesn't it?). The answer to me is obvious. Have Israel move. Our border with Mexico is 1,951 miles long, (3,141 km.). Just establish the New Israel along the border with Mexico, say a strip, 30 miles deep and 1,951 miles long. The climate is basically the same and certainly more land then Isreal has now. It would be mutually beneficial: Jews would have a homeland close to relatives in the US and we are not using the land, (since most of it, like Israel, is desert) ... and as part of the deal, the Israeli military would keep illegal aliens out.

KANSAS CITY, Mo. -- ACLU Sues for Anti-Gay Group That Pickets at Troops' Burials. "A Kansas church group that protests at military funerals nationwide filed suit in federal court, saying a Missouri law banning such picketing infringes on religious freedom and free speech. The American Civil Liberties Union filed the lawsuit Friday in the U.S. District Court in Jefferson City, Mo., on behalf of the fundamentalist Westboro Baptist Church, which has outraged mourning communities by picketing service members' funerals with signs condemning homosexuality." Free speech is not unfettered. It can be regulated when there is a compelling State interest. Schenck v. United States, 249 U.S. 47 (SC 1919). "We admit that in many places and in ordinary times the defendants in saying all that was said in the circular would have been within their constitutional rights. But the character of every act depends upon the circumstances in which it is done. Aikens v. Wisconsin, 195 U.S. 194, 205 , 206 S., 25 Sup. Ct. 3. The most stringent protection of free speech would not protect a man in falsely shouting fire in a theatre and causing a panic. It does not even protect a man from an injunction against uttering words that may have all the effect of force. Gompers v. Buck's Stove & Range Co., 221 U.S. 418, 439 , 31 S. Sup. Ct. 492, 55 L. ed. 797, 34 L. R. A. (N. S.) 874. The question in every case is whether the words used are used in such circumstances and are of such a nature as to create a clear and present danger that they will bring about the substantive evils that Congress has a right to prevent. It is a question of proximity and degree. When a nation is at war many things that might be said in time of peace are such a hindrance to its effort that their utterance will not be endured so long as men fight and that no Court could regard them as protected by any constitutional right." Interesting isn't it, how we are willing to suspend the rule of law, when there is a perceived/voiced threat to national security? I suppose the question becomes, "Does congress have the power to regulate speech by limiting it's exercise during a short period of time and exclude, during that time, demonstrators from given locations?" I believe the courts will uphold a ban, (a bad precedent because it could also be used to ban demonstrations within X distance and X amount of time, during a political event.)

WASHINGTON (AP) -- Senate passes interstate abortion notification. "A bill that would make it a crime to take a pregnant girl across state lines for an abortion without her parents' knowledge passed the Senate Tuesday, but vast differences with the House version stood between the measure and President Bush's desk." So share with me ... how important an issue this is ... that our Congress spend it's limited time and resources ... fighting over it? How many girls are being taken across State lines, by 3rd parties, without their parents knowledge or consent, for an abortion? Why wouldn't/shouldn't the parents know that their child is pregnant? That some 3rd party is taking their kid to another State? Sounds like really good parents ... who would care, one way or the other? Wouldn't it be more likely, these parents would be taking their kid across State lines for an abortion? I haven't seen anybody burning flags lately ... so we need a "Flag Burning Amendment"? State laws banning same sex marriage, are routinely upheld by State Supreme Courts ... so we need a Constitutional Amendment for that as well? The Congress of the United States of America REALLY needs to solve these problems??? How about things like: we now have 46 Million, middle class Americans without health insurance. Gasoline is getting close to topping $3.00 a gallon, (and we still have a gas guzzler tax credit). Israel is in Lebanon. We have troops dying in Iraq and Afghanistan. Iran is developing the ability to manufacture nuclear weapons. North Korea has them. Pakistan is increasing it's ability to manufacture them ... and an Avian Flu pandemic is on the horizon. Don't these seem like more important issues?

WASHINGTON (Reuters) -- Study: More Americans too fat for X-rays, scans. "More and more obese people are unable to get full medical care because they are either too big to fit into scanners, or their fat is too dense for X-rays or sound waves to penetrate, radiologists reported Tuesday. With 64 percent of the U.S. population either overweight or obese, the problem is worsening, but it represents a business opportunity for equipment makers and hospitals, said Dr. Raul Uppot, a radiologist at Massachusetts General Hospital." It is also a great business opportunity for prosthetic makers ... and morticians. As a society, we are having to "supersize" clothing, furniture ... and even make injection needles longer, so they can penetrate an ever increasing layer of fat. The fact remains, being obese poses a greater health threat than smoking, drinking and living in poverty.

And in the ... "His Momma must have dropped him on his head when he was a baby department" .... NEW YORK (REUTERS) -- Inmate signs real name to bomb hoaxes. "A prison inmate pleaded guilty on Tuesday to sending letters to the FBI and secret service that included bomb and anthrax threats -- as well as his full name and inmate number. Donald Ray Bilby, 30, pleaded guilty in U.S. District Court in Trenton to one count of false information and hoaxes after he sent five letters demanding authorities deposit $20,000 in his county jail inmate account because he needed money for bail, the U.S. Attorney's Office said." I can only surmise Mr. Bilby stands indicted for Meth use and distribution. Who says it doesn't burn brain cells?

BOSTON, Massachusetts (AP) -- Couple at center of same-sex marriage case splits. "The lesbian couple whose lawsuit led to legal same-sex marriage in Massachusetts have announced they have separated. "Julie and Hillary Goodridge are amicably living apart," Mary Breslauer, a local political consultant, said Thursday night on their behalf. Breslauer declined to comment on how long they had been separated or whether the couple planned to divorce." I feel bad for the couple. But a part of me ... the "loves aftermath lawyer" part is smiling. I have a feeling, (although I doubt there is much research on the topic yet), that the marriages of gay couples will have the same failure rates as heterosexual marriages. With gay couples electing to adopt children, there will be the same custody battles. I guess, as long as there is love and alcohol ... we "love's aftermath" guys will have job security. And in other "gay" news:   Chicago (BBC News) - Flamboyant finale for Gay Games. "The seventh Gay Games, a four-yearly event celebrating gay athletes, has ended in a blaze of color, disco and pageantry in the US city of Chicago. An estimated 12,000 athletes took part in this year's Games, which included same-sex versions of events such as figure skating and ballroom dancing ... Chicago's Mayor, Richard M Daley, said the city had enjoyed hosting the games ... Mr Daley has been campaigning in support of Chicago's bid to hold the 2016 Olympic Games ... US pop singer Cyndi Lauper sang at the closing ceremony." I have no doubt the finale was flamboyant ... very fashionable and well done. <smiling> .... a gay time was had by all! :)

Editing these Ramblings, sipping on some Sherry and listening to the evening news. Yet another peace plan, which requires Israel to give up more land. No doubt, Hesbalah will declare another victory, recruit more fighters and continue on with it's terrorist attacks on Israel. <smiling> ... I still think my "New Israel" idea is a good one. A "win - win" for all involved, (might even lead to some interesting new Jewish cuisine ... like ... gefilte fish ... in a green salsa ... you listening Poppa S??). Tried something new today, campaigning. Hit houses that had my opponents yard sign. Walked up to the door ... if a person answered, I said: "Hi. My name is Karl Timmerman, I'm running for Associate Circuit Judge in Warrensburg. I noticed you had my opponents sign in your yard. You will vote as you vote, but I wanted to introduce myself so you could make an informed choice .... " and then went into why I am the better candidate. A very effective way to honor the fact, that as Americans, we have a secret ballot that allows a person to vote for the person they wish. Just another reason to cherish the rights we have.

Another reason to give Thanks tonight, as I fall asleep curled around the person that makes campaigning bearable. The person who makes waking up each morning the joy it is. I will also say a prayer for the safe return of our men and women in uniform ... care to join me? <whispering> .... Please, Please, Please, God ... let our men and women in uniform come home safe and soon .... and Please God ... grant us the wisdom to find a way to live and love in peace. Be and sleep well ... it will be a hot summer night ... and those that protect your right to vote ... those that ensure, you have the freedom to work and the freedom to better yourself ... so you can afford air conditioning ... are on watch in the sweltering heat, so YOU can. If my post offends, I apologize ... that is not my intent. My intent remains ... a sincere desire to make you smile/chuckle about the human condition ... and perhaps, cause you to think. As always ...
