These are the Ramblings of a small town, (Holden, population 2,700), Missouri, country lawyer. They contain my random thoughts and observations on current events and my life and experiences in the Solo Practice of law.
Compiled here are the Ramblings for 2002 - 2006.

I have decided to finish my legal career serving the citizens of Johnson County, Missouri as their Associate Circuit Judge.  I ask for your support.

Greets and Huggers. Posted the evening of July 7, 2006. Watched "The Super Nanny" Monday night .... sort of a "Dog Whisperer" for children. Interesting show to watch. Sure not the way I was raised. My parents had "rules".  There was no negotiation. They made it perfectly clear ... chose to abide by them ... or get your ass whipped.  I must have been a quick learner ... I can only remember getting spanked once, (frankly, looking back ... well deserved).  Guess we are "enlightened" now. We negotiate "rules" with our children. No longer "spank", instead .... "reason" and use "time outs". After all, isn't the current "phrase de art" ... "Is it good for the children?" So, I guess, after a million years of evolving to be the most successful species on this earth ... it is time for a change. From a species survival standpoint ... when did that change? When did the survival of offspring, become more important, than the survival of the parents? How about we start asking, as a matter of public policy .... "Is it good for the parents ... so they can raise their children well?" ... and in the parenting gone nuts department .... YAOUNDE , Cameroon (Reuters) -- 'Breast ironing' to stunt girls' growth widespread. "Worried that her daughters' budding breasts would expose them to the risk of sexual harassment and even rape, their mother Philomene Moungang started 'ironing' the girls' bosoms with a heated stone ... "Breast ironing" -- the use of hard or heated objects or other substances to try to stunt breast growth in girls ... A new survey has revealed it is shockingly widespread in Cameroon, where one in four teenagers are subjected to the traumatic process by relatives, often hoping to lessen their sexual attractiveness." How can breast mutilation be a successful survival strategy, if it results in women unable to breastfeed ... or so ugly, no male would show an interest? If you think about it ... we really are a self limiting species. How could we have become so successful?

WASHINGTON (AP) -- High court to consider San Diego's memorial cross. "The Supreme Court intervened Monday to save a large cross on city property in Southern California. A lower court judge had ordered the city of San Diego to remove the cross or be fined $5,000 a day ... Lawyers for San Diegans for the Mount Soledad National War Memorial said in an appeal that they wanted to avoid the "destruction of this national treasure." And attorneys for the city said the cross was part of a broader memorial that was important to the community." The cross is part of a war memorial, dedicated to Korean War Veterans in 1954. "In May, U.S. District Court Judge Gordon Thompson, Jr., ordered the city to take down the 29-foot cross before August 2 or pay daily fines of $5,000. Thompson's ruling, which he described as "long overdue," found the cross to be an unconstitutional display of government preference of one religion over another." I guess the vast majority of crosses on the headstones at Arlington ... means ... the majority of folks buried there are Christian. Is that an unconstitutional display of governmental preference of one religion over another ... or .... our demographics are such, that there just happen to be more folks who profess to be Christian.?

ROCHESTER, New York (AP) -- Cemetery gets its boom back. "A rare Civil War cannon that was quietly sold to a collector and then returned for an inflated price after public outcry is back at Groton Rural Cemetery, where it had sat undisturbed for over a century ... The town's cemetery association sold the cannon, one of only 78 known survivors from the war, in 2004 ... A search of historical records determined that Groton's 145-year-old cannon didn't actually belong to the group. It was bequeathed to a veteran's post, and the circular plot where it stood was donated to the town in 1901 ... The buyer, Kenneth Watterson, agreed to return it on the condition that he get $23,000 -- the $15,000 he paid, plus $5,000 for a replica he'd supplied, plus a $3,000 broker's fee." So share with me why Mr Watterson has any right to receive an additional $8,000.00 for returning a stolen item? Given, he has a right to recover the $15,000.00 he paid, from the cemetery association, (who sold him an item they did not own) ... but a $3,000.00 "broker's fee? Did the cemetery association even consult a lawyer?

BOCA GRANDE, Florida (AP) -- Eating for 56? Heavily pregnant shark surprises scientists. "The likely world-record hammerhead shark caught in May weighed 1,280 pounds because it was pregnant with 55 pups -- the most scientists have ever seen ... "Although we are thankful that the fisherman gave this unique specimen to Mote, and we are learning a lot about this species from this large female shark, we were saddened to see so many unborn pups inside her so close to birth," said Dr. Robert Hueter," 56 unborn puppy sharks, murdered! Where are the "Right to Life" folks when you need them?

CAIRO, Egypt (CNN) -- Gonzales: Gitmo ruling 'hampered' war on terror. "The Supreme Court decision that ruled against the Bush administration's plan to try suspects being held at Guantanamo Bay prison has "hampered our ability" to deal with terrorists, the U.S. attorney general said Saturday ... "What this decision has done is, it's hampered our ability to move forward with a tool which we had hoped would be available to the president of the United States in dealing with terrorists," Attorney General Alberto Gonzales told CNN." Ok. The rule of law is an inconvenience ... I can understand that mentality ... after all, not a new concept/mindset ... didn't Machiavelli propose that the "ends justify the means" a few centuries ago? Isn't it amazing, how quickly some folks are willing to suspend our civil liberties in the name of "security" ... like allowing warrantless wiretaps in the name of expediency, when that issue was addressed by a special court, formed to expedite the issuance of warrants?

GREENVILLE, S.C. (AP) -- Mascot charged with fondling fan. "A man who played the mascot for a minor league baseball team was arrested after a woman said she was fondled at a game in April. Cecil McLaurin Amick III, 37, of Boiling Springs, portrays Reedy Rip'It, a giant frog for the Greenville Drive of the Class A South Atlantic League. He faces a misdemeanor charge of molesting." How traumatic is that? Getting groped by a giant green frog? .... <whispering> .... rumor has it, Miss Piggy was in therapy for years!

And in the world class "stupidity" department ... GAZA CITY (CNN) -- Hamas orders Palestinian forces to fight Israel. "The Hamas-led Palestinian government ordered its security forces Thursday to fight back against the Israelis who have been hammering Gaza with airstrikes and artillery since one of their soldiers was kidnapped last month ... As many as 25 Palestinians may have died in Thursday's fighting, though there were conflicting death tolls ... Palestinian Interior Minister Saeed Siyyam told security forces to rise up and "confront this incursion and cowardly Zionist aggression," Hamas, now the dominant Palestinian political party, has militants which have been shelling Israel, killing innocent civilians. Israel is conducting raids designed to weed them out and provide security for boarder settlements. As a show of good faith, Israel moved out of the Gaza Strip and turned the land over to the Palestinian Authorities. The Israeli Defense Force, (IDF ), is one of the best armed, best trained, fighting forces in the world. For the Palestinian Interior Minister to call for his forces to "confront this incursion" is akin to asking a 14 year old kid to attack an M1A2 Abrams Tank with his slingshot. There may be a shortage of virgins in paradise for awhile.

Sitting here finishing off these Ramblings and getting ready to head out for the Johnson County Fair. I'm tired and I really don't want to go .... I would just like to spend a quiet evening at home with Susan, sipping on some Sherry and snuggling. while watching a movie together. When running for office, you have no time for yourself. Everything becomes part of your "campaign". Like anything worthwhile in life ... there is always a price to pay. I may just stay home and spend all day tomorrow at the fair, instead. Tonight, as I fall asleep next to my Susan ... and I will say a prayer of THANKS, for having the options in life I do, (and a prayer for the safe return of our men and women in uniform ... care to join me?) Be and sleep well ... and tonight as you fall asleep ... perhaps, take a moment and think about the freedoms you enjoy, not the least of which being ... having options/choices. If my post offends, I apologize ... that is not my intent. As always ....
