These are the Ramblings of a small town, (Holden, population 2,700), Missouri, country lawyer. They contain my random thoughts and observations on current events and my life and experiences in the Solo Practice of law.

Greets and Huggers. Posted the evening of June 17, 2005. Can you tell me why human life is special, has greater value, is more important, in the eyes of God ... than the rest of his creation? A special about whales, on the "Discovery" channel, made me wonder. Whales are magnificent creatures. The largest mammals on this Earth. Mothers rear their young, breast feed, while gliding along the oceans of this world, seeing their environment, with sound. Who has not heard their song and marveled at it's beauty and their intelligence? Yet, we have hunted them to the verge of extinction ... before we implemented a universal ban. But three Nations, still hunt/kill them for "scientific purposes". "Whaling nations -- mainly Japan, Norway and Iceland -- are allowed to kill whales for scientific purposes under rules of the International Whaling Commission (IWC) even though the IWC imposed a moratorium on all commercial hunts in 1986." Not exactly 3rd World countries with starving populations, are they? Strange how whale meat winds up on the dinner tables and on the menu of restaurants, in these Nations, isn't it? Why? While here, in our America, "A federal judge has ordered the U.S. government to draw up plans to protect North Pacific right whales, thought to have been extinct until they were rediscovered in the Bering Sea three years ago."

I have never tasted whale meat. Is it THAT special? Never have seen it on the menu, of any restaurant I've been to. So share with me ... God gave us, as a species, stewardship, dominion, over this, His creation ... isn't that what the Bible teaches? If I were God, I'd be pissed. I would have second thoughts. I would rescind the "dominion" agreement, based on our failure to perform. Our failure to be good stewards! So, share with me, why God would love whales, less than us? Aren't they elegant, beautiful creatures? ... How could He not? Where did we come up with this "we are created in His image" crap? Have you considered the possibility that God has NO PHYSICAL IMAGE ... or Whales consider, they are created in His image? So why is human life special? Has greater value, is more important, in the eyes of God ... than the rest of his creation? Perhaps God sent his only begotten Son/Daughter, in physical form, as a Whale, to Whales, to die for Whale sins? (I wonder what whale sins look like? Screwing a dolphin on the side? Screwing other Whales out of their Krill?) ... didn't God give us a "superior" intellect so we can better question and fulfill our obligation as stewards? And we use it for what? Develop better and more efficient ways of raping our environment? Killing eachother? God gave us freedom of choice ... look at the choices we make, like ... "Two employees of People for the Ethical Treatment of Animals have been charged with animal cruelty after dumping dead dogs and cats in a shopping center garbage bin." Why God would just watch the things we do, questions my faith. Maybe Whales decided to stop believing in a God ... that does nothing to save them. I wonder how many Jews lost faith ... praying ... as they walked into shower stalls.

Michael Jackson was acquitted, (reasonable persons on his jury had a doubt.) A triumph, for a system of justice that would rather watch a guilty person go free ... than seeing an innocent person be executed. Had a friend comment, "With all this smoke, there must be fire". Doesn't that beg the question ... "Who started the fire?" The prosecutor ... or the actions of the Defendant?" Nice to know, being weird, is not a criminal offense, (provided you have a bag full of money, to hire the best defense lawyers, money can buy ... didn't the O.J. Simpson case, teach the same lesson?) Always wondered about the difference between being "eccentric" and "crazy". Guess the difference ... <smiling> ... is money. I wonder what the difference is ... between being found "not guilty" ... and being proven "innocent"? Could it be money?

In news from around the world, the big news in Japan is ... "A controversial report and photos a Pulitzer Prize-winning American journalist produced on the aftermath of the 1945 atomic bombing of Nagasaki have been unearthed almost 60 years after U.S. military censors forbade their publication, the Mainichi has learned ... American George Weller was the first foreign reporter to enter Nagasaki following the U.S. atomic attack on the city on Aug. 9, 1945. Weller wrote a series of stories about what he saw in the city, but censors at the Occupation's General Headquarters refused to allow the material to be printed. Weller's stories [were], written in September 1945." To read the complete series of articles by Pulitzer Prize-winning American journalist George Weller, (he passed away at age 95 in 2002), click HERE. The articles are a fascinating read and an incredible insight into that periods zeitgeist.

In other news, "A drug targeted specifically for black Americans with heart problems is on track to become the first drug in the U.S. marketed to a specific racial group ... The drug's trial, on just over 1,000 individuals, was launched after the FDA turned away the medication following a study involving all races that showed little improvement -- but also gave hints that blacks might have had some benefit. The maker, NitroMed of Lexington, Mass., then decided on a trial using blacks only, a population that has more than twice the rate of heart failure as whites." The drug BiDil showed a 43 percent decrease in the one-year mortality rates among African-Americans suffering from heart failure but proved ineffective for white Americans. Don't you have to wonder why? Are there drugs that only work for Asian Americans or Hispanic American?

On Avian Flu? The Pandemic has started in China. "... there are now two independent reports on isolation wards being set up near H5N1 bird flu deaths of migratory birds and domestic geese. These reports raise possibility that H5N1 is being efficiently transmitted human to human at two locations in western China, signaling the start of final phase 6 in the 2005 flu pandemic." And in the news today, "The media reports indicate that there are now 23 cases at the Institute for Tropical Medicine in Hanoi. As noted above, the prior reported record was 5 for a hospital. There appear to be 21 new cases admitted since last week." One of the infected persons, was their doctor. There is no doubt the Avian Flu bug is now easily transmitted human to human. They may or may not contain it. Guess we will see. 'Nuf said.

Sitting here editing these Ramblings, sipping on some Creme Sherry and thinking about the articles written by George Weller. They share a view of an entirely different world. Think of the differences between our America in 1945 and now. On the evening news, another security breach. Information on 40 million credit cards at Mastercard International, (the company that processes credit card payments) was hacked. Employees of the company new about the security breach since May 22 but only made it public today. Why in the world did they wait? A major election in Iran today. It looked democratic ... but then, so did the election in North Korea, (only one candidate). In Iran, only candidates approved by the Mullah's were allowed on the ballot. Remember, they are developing a nuclear weapon!!! And the price of oil surged to an all time high today, $58.00 a barrel. So share with me again ... how much do you like your SUV ) Five earthquakes off the coast of California this week. "There is a heightened probability of a major earthquake." Perhaps next week, we will be trying to find the coastline? After the release of Terri Schiavo's autopsy this week, (showing her brain was mush), "Gov. Jeb Bush asked a Florida prosecutor today to investigate what he said were varying accounts of the time that had elapsed between Terri Schiavo's collapse 15 years ago and the moment that her husband summoned help." ... <shaking his head> ... I imagine the US Senate will now convene a committee to investigate this issue as well, (and it's not even an election year!!!) Don't you wonder what these political mental munchkins will come up with, when it is? Obviously not minor issues, like health care, social security, the war on terror and an out of control tax system, et. al. <sigh> Guess it's time to publish these Ramblings ... <smiling> ... for the 10 - 20 folks who are waiting to read them )

Tonight, as I'm want to do, while curled around the most beautiful woman I know, (my Susan), I will give thanks for the many blessing we enjoy ... not the least of which, being curled around the most beautiful woman I know, (we sleep au natural so I don't have to worry about zippers) and a prayer for our men and women in uniform, (care to join me?) .... <whispering> .... Please, Please, Please, God .... let them come home safe and soon! Be and sleep well, our men and women in uniform are on watch, so you and yours, can. As always ...
