These are the Ramblings of a small town, (Holden, population 2,700), Missouri, country lawyer. They contain my random thoughts and observations on current events and my life and experiences in the Solo Practice of law.
Compiled here are the Ramblings for 2002 - 2006.

I have decided to finish my legal career serving the citizens of Johnson County, Missouri as their Associate Circuit Judge.  I ask for your support.

Greets and Huggers. Posted the evening of April 28, 2006. I have been told, "There is only one of you", (not sure if that is a compliment, or not.) But true. There really only is one of me. There is also, only one of YOU. You are a unique creation, (whether by "intelligent design" ... or nature's fiat). [God, I love the word "Fiat" .... reminds me of a piece of sh*t car produced by the Italians.] I wonder if any individual matters ... when you look at the thousands/millions killed at the hands of our fellow human beings. What is the value of an individual life? Better yet, who has the power to value it? I know, I don't. For example, the unborn have/remain declared priceless ... yet, once born, in some instances, they are forced to live lives, not, by any reasonable definition, worth living. Hungry, abused, unloved, with no promise/hope of ever enjoying the things you and I take for granted. Why does an unborn child have more value, to some, than children "in being"? Why are so many resources expended defending the unborn ... and so, so, so much fewer resources expended, on the abandoned children, living among us? Share with me the logic behind seeking to criminalize abortion, while upholding the right of persons to create and store multiple embryos ... most of which will be "discarded" ... while there are so many children standing in line, living in foster care, waiting to be adopted? And the "unused" embryos? They are discarded ... a nice way of saying, they are killed, (while researchers, medical professionals, cry for new "stem cell" lines to allow them to find cures for the afflictions, you and I suffer). So share with me ... see any "pro-life" protestors in front of fertility clinics lately? Why? Perhaps, we should re-name clinics which perform abortions ... "in-Fertility Clinics"? And fertility clinics, "Pre-Birth Day Care Centers". All in a name, isn't it? How much is an individual life worth? In most parts of the world .... not much. Oh, by the way, another bunch of persons were shot in the head, after unspeakable torture, in some 3rd world countries today, (and also, perhaps, in our America). They were as unique as you and I: there also was only one of them .... as well ... wasn't there?.

So ... a hundred years from now .... <looking at my Dear Friends, Dan Ryan and Bryan Scheiderer, et,. al.> ... will your "Blog" be readable? Will my images or these Ramblings exist in a form ... or exist at all .... so our great, great, great, grandchildren will be able to read, enjoy, and help them understand the times we lived in ... our thoughts, feelings and fears ... and what we learned? I checked the links in 2003 Ramblings ... and some are gone. So much of the early Internet has already been lost .... just a power failure or "format" away. As a species, we have a recorded history going back thousands of years, etched in stone, clay, papyrus and paper. Now the preferred storage media is electronic, with changing formats and a very finite shelf life. Isn't it time for us to develop a strategy for archiving our current knowledge base in a form that will survive a power failure? There is a way we can preserve these snipits of history, isn't there?.

WASHINGTON (Reuters) -- Scientists find secret to gas-free beans. "Two strains of bacteria are the key to making beans flatulence-free, Venezuelan researchers reported on Tuesday. They identified two bacteria, Lactobacillus casei and Lactobacillus plantarum, which can be added to beans so they cause minimal distress to those who eat them, and to those around the bean-lovers ... " hmmm ... I wonder if this will silence Venezuelan President Hugo Chavez?

PORTLAND, Oregon (AP) -- Doc's diagnosis: Nail gun caused headache. "An Oregon man who went to a hospital complaining of a headache was found to have 12 nails embedded in his skull from a suicide attempt with a nail gun, doctors say. Surgeons removed the nails with needle-nosed pliers and a drill, and the man survived with no serious lasting effects, according to a report on the medical oddity in the current issue of the Journal of Neurosurgery. The unidentified 33-year-old man was suicidal and high on methamphetamine last year when he fired the nails -- up to 2 inches in length -- into his head one by one." Hey! No one ever said "natural selection" was 100% effective!

FINDLAW --- When Oral Sex Results in a Pregnancy: Can Men Ever Escape Paternity Obligations? "In a lawsuit against his ex-girlfriend, Richard O. Phillips has alleged that about six years ago, he engaged in oral sex with her. Unbeknownst to Phillips, he says, his girlfriend, Sharon Irons, allegedly saved the resulting semen and used it to inseminate herself. A pregnancy resulted, Irons gave birth to a baby, and DNA tests proved Phillips to be the genetic father. Though Phillips allegedly did not learn of either the pregnancy or the birth until some time later, a court nonetheless ordered him to pay approximately $800 a month in child support. " . So, who do you believe? He testified he only engaged in oral sex and she testified she got pregnant the old fashioned way. Missouri has the "Zipper Rule" ... I know it's hard to swallow, but if you are male, you are strictly liable for the consequences which flow from dropping your zipper. Further, Missouri does not recognize "wrongful life" actions, (see Wilson v. Kuenzi, 751 S.W.2d 741 (Mo. 1988)) Talk about paying lip service for abstinence ...

And in other "life sucks" news: CHICAGO, Illinois (AP) -- Cleared by DNA, he's killed by traffic. "A man who spent 12 years in prison for murder before new DNA testing exonerated him last year was killed in a hit-and-run as he walked on the city's South Side. The vehicle sped away after hitting Dan Young Jr., 45, Wednesday night, police said. He was pronounced dead Thursday, the Cook County medical examiner's office said." Talk about "life not being fair"! Spend 12 years in prison, for a crime you did not commit ... then, when you are proven innocent and get released, you get knocked off by a hit and run driver, just before the State pays you your "clemency" money? Sheesh!! Sucks to be him!

MIAMI, Florida (AP) -- Oh say can you see the national anthem in Spanish? "British music producer Adam Kidron says he just wanted to honor the millions of immigrants seeking a better life in the U.S. when he came up with the idea of a Spanish-language version of the national anthem." ... and our President's response: WASHINGTON (AP) -- Sing the U.S. anthem in English only, Bush declares. "The national anthem should be sung in English -- not Spanish -- President Bush declared Friday, amid growing restlessness over the millions of immigrants here illegally." Same melody but different words, (apparently the verses don't translate well). Give me a break! Who cares? It's not like the Chiefs will be playing the Spanish version at the season opener! .... Perhaps the Tampa Bay Buccaneers and Royals would, though. And this Monday: (CNN) -- "Meatpacking plants will shut down. Markets won't open. Trucks won't roll. Students will walk out of school. Millions of people will take to America's streets in possibly unprecedented numbers ... "Millions of workers, men and women without documents and their supporters who are, in fact, legal United States citizens will heed the call to not go to work," said Juan Jose Gutierrez, national coordinator of Latino Movement USA and one of the lead organizers of Monday's planned boycott." Wow! What a great opportunity for INS to round up illegal aliens and get a heads up about where they are working. ... and ... MEXICO CITY, Mexico (AP) -- Mexican lawmakers support U.S. immigration protest. "Mexican lawmakers issued a declaration of support for immigrant protests planned in the United States on Monday and said they will send a delegation to Los Angeles to show their solidarity." Golly gee, aren't these the same folks who criminalized , made it a felony, to immigrate to Mexico illegally ... and they are showing support for those who do so here? You know ... how about we translate the Mexican National Anthem into English and broadcast it over the boarder!

Sitting here editing these Ramblings and thinking about campaigning tomorrow. Have a BBQ at the Methodist Church in Warrensburg at 4:30, dessert at the Centerview Christian School Fundraiser at 5:15 and a Fish Fry at the Holden Masonic Lodge at 6:00. On the evening news, Rush Limbaugh was arrested today, for prescription drug abuse, ($10,000.00 a week on Oxycodone). On economic news, a 20% increase in consumer spending and a 15% increase in business spending. Worry about the high cost of oil and oil products, while the oil companies post record profits. Iran continues to work at building a nuclear weapon, (including a promise to share nuclear technology with the Sudan). Russia and China continue to support Iran. 70 of our troops were killed in Iraq this month, (no mention of the number of Iraqi's killed, although a quick check of CNN news reports, shows hundreds more).

This week served as a "wakeup call", that participation in this reality is tenuous. We all are only "passing through". I attended Mary Larson's funeral, a celebration of her life ... and no doubt, a life, (although too short), well lived. Some believe only human beings have a "soul", (we are created in the image of God). I believe that definition too narrow ... it implies that God loves His other creations less. I have faith, that an all loving God is ALL loving. I continue to believe that all living beings/things have a physical component and that which animates that physical component, that which makes it "alive", I choose to call that "soul". "Justy" Timmerman passed this week as well. She was a small, meek, gentile soul, (just a little Yorkie) ... but a joy in Susan and I's life. We miss her, now she is waiting for us at the Rainbow Bridge, with "Cutter " and "Maggie ". I am thankful for the lives, two and four legged, that touch Susan and I's life ... and I am most grateful/thankful for Susan. Tonight, as I'm want to do, I will say a prayer of thanks ... and a prayer for the safe return of our men and women in uniform, (care to join me?) .... <whispering> .... Please, Please, Please, God .... let them come home safe and soon!!! Be and sleep well, take a moment and look at all you have, and thank, in your heart, those that defend it for you. If my post offends, I apologize ... that is not my intent. As always ....
