The "Ramblings" are a series of emails sent, for the most part, on Friday night, to the Missouri Solo and Small Firm Internet Group, ("the List"), listserve. "The List" is a "support" group, a virtual "family", comprised of Missouri Solo and Small Firm Lawyers. It is not affiliated with the Missouri Bar Association: "the List" is self governing and self moderating. Compiled here are the Ramblings for 2002 - 2004. They contain my random thoughts and observations on current events and my life as a Solo Lawyer. They are the Ramblings of a small town, (Holden, population 2,700), Missouri, country lawyer.

Greets and Huggers. Posted the evening of March 12, 2004. Some things don't change: "As American soldiers sitting on the back of trucks passed us they waved, and we shouted even louder. On the way back, the teacher lectured us: "Children, you must remember that those soldiers came from very far away, leaving their families, friends and neighbors in America. They're here to defend peace and justice of the world, because if they lose our country to the communists, it will be a threat to all mankind" '. Believe what you will about our involvement in WWII, the Korean "Police Action", Vietnam, Gulf War 1, Afghanistan ..... and now Iraq .... we, as Americans have paid the price .... anted up to the Bar and made the sacrifice .... IN LIVES ... to claim the moral high ground. For those who choose to look, take the logs out of their eyes ..... take stock .... the view is breathtaking!! I will not be alive ..... but 50 years in the future ... have no doubt .... there will be a short note in "Starmagazine" from a little Iraqi girl that reads: "As American soldiers sitting on the back of Humvees and Tanks passed us, hey waved, and we shouted even louder. On the way back, our teacher lectured us: "Children, you must remember that those soldiers came from very far away, leaving their families, friends and neighbors in America. They came here to remove an evil man and his sons, a dictator who had enslaved us. Took the riches of our land for his personal use. For three generations, killed hundreds of thousands of the best and brightest of us ... used biological weapons against some of us to stay in power. These soldiers forced the creation of a new Iraq ... forced the adoption of a Constitution that recognized the equality of all persons and gave us back ..... Our Freedom! ........." 'Nuff said.
This week the Center for Disease Control (CDC) announced that complications from being obese will soon be the number one killer of Americans, (replacing smoking). "In 2000, poor diet including obesity and physical inactivity caused 400,000 U.S. deaths -- more than 16 percent of all deaths and the No. 2 killer. That compares with 435,000 for tobacco, or 18 percent, as the top underlying killer." Complications include Diabetes, Heart Attack and Cancer. At the same time, Congress is scrambling to pass legislation to grant legal immunity from class action law suits to the fast food industry. I developed "My Diet", after researching all 17 of the low carb diets and reaching the undeniable conclusion that if you eat more calories, (either in the form of carbohydrates or protein) than your body burns .... your body will store what it does not use, as fat. Protein contains 4 calories per gram, carbohydrates contain 4 calories per gram and fat contains 9 calories per gram, (here is a list of the caloric content of popular foods). "My Diet" is a low carb, low fat way of eating based on the "glycemic index", (how quickly a given food is converted to blood sugar/fat). The longer it takes, the longer you feel "full", the less you eat, the lower your caloric intake. The diet works.
On a similar note, good news: "Rimonabant", a new pill/drug, (available in a year or two), that blocks the craving for food or nicotine "... by an entirely new approach ...... blocking the same primeval circuitry in the brain that gives pot-smokers the munchies." Guess that means folks who take the pill while smoking pot will not have to worry about gaining weight, (should help David Crosby ... [Crosby, Stills, Nash & Young], Crosby, by the way, just joined the New York City chapter of the NRA after being busted for a CC&W). "You, who are on the road, must had a code to live by, and so become yourself, because the past is just a goodbye ... " from "Teach Your Children", Crosby, Stills, Nash and Young. Obviously he forgot that part of the "code" that teaches: don't leave your "stash" and loaded .45 in your hotel room! Crosby is 62.
Interesting reading: "Vices Are Not Crimes, A Vindication of Moral Liberty", by Lysander Spooner. (Spooner, a lawyer, was without a doubt, one of America's greatest dissidents!) "Vices are those acts by which a man harms himself or his property. Crimes are those acts by which one man harms the person or property of another. Vices are simply the errors which a man makes in his search after his own happiness. Unlike crimes, they imply no malice toward others, and no interference with their persons or property. In vices, the very essence of crime - that is, the design to injure the person or property of another - is wanting. It is a maxim of the law that there can be no crime without a criminal intent; that is, without the intent to invade the person or property of another. But no one ever practises a vice with any such criminal intent. He practices his vice for his own happiness solely, and not from any malice toward others." Geez, we sure have come a long way since 1875. Now, all of our vices are either regulated or criminalized.
This week, a study was released suggesting teens who take a public vow to remain virgins until they marry, are just as likely, if not more likely, to catch STD's (Sexually Transmitted Diseases), as teens who don't: " ... in communities where at least 20 percent of adolescents pledged to remain virgins, the STD rates for everyone combined was 8.9 percent. In communities with fewer than 7 percent pledgers, the STD rate was 5.5 percent." On the news today: the FDA, may require warning labels on condoms, (give me a break .... who would take the time to turn on the lights and read the warning label on a condom. What would it say? "WARNING: THE ARROW POINTS TO THE FRONT. UNLESS PROPERLY APPLIED, YOUR PENIS WILL ROT OFF??) .... and there is a new drug resistant strain of syphilis making the rounds. Not a good news week for the "just say no" crowd.
Sitting here sipping some BBB, (will bring some to Dan Ryan's house tomorrow), editing these Ramblings and listening to David Crosby's "Hero" from his "Thousand Roads" album. We lost two more soldiers in Iraq today: a roadside bomb, (Please, God, comfort their families ... and please, please, please let all our remaining soldiers come home safe and soon). I wonder if a little Iraqi girl witnessed that as well?: I wonder if she could understand the sacrifice? From "Hero": "It was one of those great stories, that you can't put down at night, the hero knew what he had to do, and he wasn't afraid to fight ..... And the reason that she loved him, was the reason I loved him too, and he never wondered what was right or wrong, he just knew, he just knew". We all know what to do and the vast majority of us do it. Our "Heros", our men and women in uniform, who go in harms way, abroad or patrolling the streets in our respective "home towns" or waiting for the next call, know what they have to do .... no drama, no drum rolls, just quietly doing their jobs. (I can still remember the expression on the face of that firefighter climbing UP the stairs on 9/11). Tonight, as I go to sleep curled around the most beautiful partner a man can have .... I will say a special prayer for that little Iraqi girl, for our "heros" and for you and I. Be and sleep well knowing, the best there is, our "heros", are on watch, so you can. If my post offends, I apologize .... that is not my intent.
