These are the Ramblings of a small town, (Holden, population 2,700), Missouri, country lawyer. They contain my random thoughts and observations on current events and my life and experiences in the Solo Practice of law.
Compiled here are the Ramblings for 2002 - 2005.

I have decided to finish my legal career serving the citizens of Johnson County, Missouri as their Associate Circuit Judge.  I ask for your support.

Greets and Huggers. Posted the evening of January 27, 2006. "Evolution " teaches, (forgive my simple explanation), that each individual being, (from the most simple, to the most complex), is unique, (in human terms, look around ... have you ever seen a person identical, in all ways to you?) These individual traits, which make a being unique, provide survival probabilities, as a function of the individual's interaction, with their environment: individuals who have these traits, traits that allow them to survive environmental changes. or allow them to use the resources in their environment more efficiently, reproduce and pass those traits on to their offspring. Those that lack these traits die, or are not as successful reproducing. Over time, individuals with successful survival traits, become dominant, in a given population. If organisms don't "evolve", share with me why bacterium, over the past 50 years, have developed drug resistance? Is a "Supreme Designer", creating new bugs, able to survive the toxins, we have developed, to destroy them? If so, why? To plague those who have been "created in His image"? The fact remains, all evidence suggests, "natural selection" is a viable "theory" ... as opposed to a hypothesis. Need evidence, or just want to have the hell scared out of you? Look at how quickly bugs have become drug resistant: staphylococcus, tuberculosis, AIDS, malaria, syphilis, gonorrhea, ad nauseam. Be worried: at this rate, the bugs are evolving faster than we can find antibiotics to fight them off.

Talking about "evolution": SYRACUSE, N.Y. (AP) - Small brain means bigger sex appeal. "For some male bats, sexual prowess comes with a price - smaller brains. A research team led by Syracuse University biologist Scott Pitnick found that in bat species where the females are promiscuous, the males boasting the largest testicles also had the smallest brains. Conversely, where the females were faithful, the males had smaller testes and larger brains." Interesting. Ok, I'll admit .... <blushing> .... I am married to a faithful female with it's appurtenant implications ... although, I question the larger brain part.

To marry in Missouri, you most be 15 years old or older, (at 15, parental consent is required), R.S.Mo 451.090. Ok, I understand that the sap starts to rise in our teenagers around 12.8 years but share with me ... what kind of a parent would marry off a 15 year old? Time to amend the statute, isn't it? Interesting discussion, (actually, a pretty rancorous "debate"), this week on the SFIG about our President authorizing NSA wiretaps. Ultimately, from my perspective, there are only two issues to discuss, both philosophical, (philosophical because neither you nor I, nor any of us, can have an impact on the outcome nor cause change): 1. Can our President suspend our Constitutional Rights at a time of war? The answer is obvious. No. Our Constitution, like any contract, is an all or nothing deal. You can not derive a benefit from some terms of a contract, ignore others and expect to enforce the whole contract. Our President derives his power to act on our behalf, contractually, from our Constitution. His failure to abide by the contract, makes his actions null and void and therefore illegal. 2. Do the ends justify the means. Contrary to popular belief ... the answer is and remains, No. Look at it this way ... you want to make a really delicious soup. You get the finest ingredients. You get the best pot. You start to cook .... and stir the soup with a spoon covered with poop. Do you really think you would wind up with the delicious soup, you started out to cook? For me, the answer really is that simple.

BBC NEWS -- Israel warns Iran on nuclear work . "The Israeli defence minister has warned that the country will not accept an Iranian nuclear capability. Shaul Mofaz said that at this stage his government gave priority to diplomatic action aimed at convincing Iran to give up its nuclear programme. But he added that Israel was preparing for any eventuality and had the "capability to defend itself", after Iran resumed nuclear research ... "Israel... must have the capability to defend itself, with all that that implies, and this we are preparing," Mr Mofaz said. Israeli leaders have repeatedly stated that any military action would be part of an international effort, and Israeli officials have denied plans for a unilateral preventive strike" And yesterday:  RAMALLAH, West Bank (CNN) -- Hamas' past casts shadow over peace plans. "The future of the Middle East entered a new era of uncertainty Thursday, as the militant Palestinian opposition group Hamas snatched power from the ruling old guard and made skeptics of many key players in the peace process." So much for the Middle East Peace process.   BBC NEWS --- Israel rules out talks with Hamas. "Israel has said it will not deal with a Palestinian government including Hamas, following the Islamic militant group's sweeping victory in Palestinian polls. Israeli interim Prime Minister Ehud Olmert ruled out any talks with "an armed terror organisation that calls for Israel's destruction". Hamas is a terrorist organization formed and dedicated to the destruction of Israel, (for Hamas' history and charter, read the link!! "There is no solution for the Palestinian question except through Jihad. Initiatives, proposals and international conferences are all a waste of time and vain endeavors." ) So Israel is now facing a Hamas led Palestine, (funded in part by Iran), and a Mullah led Iran, (in the process of developing a nuclear weapon), ruled by a President, who believes the world is within two years of the second coming.

BBC NEWS -- Oaten resigns over rent boy claim. " Former Liberal Democrat leadership challenger Mark Oaten has stood down as the party's home affairs spokesman over an alleged affair with a rent boy. Mr Oaten released a statement apologizing for the "embarrassment" caused to his family, friends and the Liberal Democrat party." .... <shuddering> .... What the hell is a "rent a boy"?

CHAMPAIGN, Illinois (AP) -- Researchers to map pig DNA. "A team of researchers won a $10 million federal grant to provide the first complete sequence of the swine genome -- a genetic map they say could help farmers produce better hogs, give consumers tastier pork and ultimately benefit human health ... The project is expected to be completed within two years at a cost of about $20 million," Well, this is obviously not a project funded by orthodox Jews.

PHILADELPHIA, Pennsylvania (AP) -- Legislatures consider potential political bias in colleges. "Christian DeJohn returned from a National Guard tour in Bosnia only to fight his own war with academics at Temple University who he says have held up his master's thesis because of political conflicts in the classroom. To some conservatives, the case represents a national trend by some liberal professors to infringe on conservative students' right to free speech at public colleges and universities." Interesting isn't it? If what is taught in our colleges and universities, does not conform to what a given legislative body believes is correct, investigate the professors ... (didn't that happen with the "creation science" course at KU???)

WASHINGTON (AP) -- Study: Students lack real-life skills. "More than half of students at four-year colleges -- and at least 75 percent at two-year colleges -- lack the literacy to handle complex, real-life tasks such as understanding credit card offers, a study found [conducted by the Pew Charitable Trusts], ... The results cut across three types of literacy: analyzing news stories and other prose, understanding documents and having math skills needed for checkbooks or restaurant tips." Well, DUH!! Haven't you noticed the nice young clerks in our stores struggling to make change, when their high-tech cash registers go down? Begs the question: "Is technology dumbing us down?", doesn't it? I'm so used to using a calculator, I have to concentrate to do manual division and multiplication. I understand some schools no longer teach the "times-table", but allow the students to use a calculator. Shouldn't come as a surprise that our children can not balance a checkbook, (why should they have to ... after all ... the credit card companies will do it for you ... if you use their credit card).

Just returned from a "file review" at 4:00 PM, in Jackson County ... a juvenile case. Hehehe ... commissioners are not judges .... they work on Friday afternoons. Sitting here editing these Ramblings and sipping on some Port. On the news, Hamas is as virulently anti-Israel as before the election. No surprise there. In light of the fact Israel has systematically assassinated Hamas leaders, after each Hamas attack in Israel .... share with me ... what do you think is the life expectancy of one of the Hamas folks elected to office? Personally .... I sure wouldn't be hanging around with them, riding with them in their car ... or having a nice quiet visit at their home. If I were them, I'd be munching down a bunch of oysters, (and keeping a 55 gallon drum of vitamin "V" real close ... to pop as I check out ... so I'm in shape for the 77 virgins waiting for me ... <scratching my head> ... or does rigor mortis carry over into the afterlife??)

All is well at Ft Timmerman ... the Port mellows me out ... relaxes me ... and makes me look forward to curling up around the best friend, partner, lover, Lady ... a man can have. As I drift off to sleep, I will say my customary prayers: a "Thank You" for having Susan laying next to me ... and a prayer for the safe return of our men and women in uniform, (care to join me?) ... <whispering> .... Please, Please, Please, God ... let them come home safe and soon! Be and sleep well, this is not a safe world, but the best there is, is on watch to make you and yours as safe as they can. If my post offends, I apologize, that is not my intent. As always ...
